ITAD and the legal framework in Bulgaria
- ITAD and the legal framework in Bulgaria
Gone are the days when you could just throw your computer equipment in the bin in front of your building or in the mixed waste bin on the nearby street.
On the one hand, people and businesses do not do this anymore because of their desire for a “greener” lifestyle. This is driven by greater awareness of what careless disposal of IT equipment can lead to, and the unwillingness to contribute to environmental damage.
On the other hand, according to the legal framework of Bulgaria, disposal of electronic waste in unregulated places is prohibited and punishable. Therefore, when the time comes to upgrade your IT equipment so that your business continues to function smoothly, contact a company like ours, which provides ITAD services. We will help you remove your old computers by purchasing them from you.
What does the law on e-waste in Bulgaria say?
Disposal of e-waste is in fact a rather complex process that must comply with and follow different regulatory frameworks.
- Waste Management Act of 13 July 2012
It is forbidden to dispose electronic waste in unregulated places, as it may have materials and components that contain toxic substances and therefore need to be processed in specially constructed facilities. The law aims, through the proper management of e-waste, to prevent, reduce or limit the harmful effects on human health and the environment.
- 2. Directive 2012/19 / EU of the European Parliament on waste electrical and electronic equipment (WEEE) of 4 July 2012;
According to this directive, you, as a business owner, are legally obliged to recycle your discarded IT equipment. Your old equipment can no longer be disposed of in landfills, but instead must be handed over to certified companies specializing in the recycling of electronic and electrical equipment. Also, you should be able to present a certificate from the company dealing with this type of waste.
- 3. Regulation on electronic waste (WEEE) effective from 1.01.2014
The requirements for the separate collection, transport, storage, pre-treatment, re-use, recycling, recovery and / or disposal of WEEE are described here. The main purpose of this regulation is to prevent and reduce the harmful impact on the environment and human health from the formation and management of WEEE.
- 4. Regulation on the requirements for placing on the market of electrical and electronic equipment and treatment and transportation of waste electrical and electronic equipment of 8.04.2011
As already mentioned, the indiscriminate disposal and treatment of e-waste is punishable and fines are imposed on both individuals and legal entities. When violations are found, the sanctions can vary from BGN 1,000 to BGN 5,000 for individuals and from BGN 1,400 to BGN 50,000 for sole traders and legal entities, depending on the violation.
